The SA Institute of Chartered Accountants (Saica) is set to drop charges against one of the first members it hauled before a public hearing earlier this year.
The organisation, according to a letter seen by City Press, decided to recommend to its disciplinary committee that charges against Munroe Swirsky be dropped owing to insufficient evidence.
“Saica has assessed the information placed before it by [Erez] Daleyot, as well as your response to the complaint. Saica is of the view that, taking into account all the information that we now have after having received your written explanation, there is insufficient evidence to proceed with the complaint.
“As previously explained, the disciplinary committee is already [dealing] with this matter and it is the only decision-making body that can determine how to proceed.
“In light of this development, the complaint will be placed before the disciplinary committee with a recommendation that – in view of the complainant’s election not to respond to your written explanation – there is insufficient evidence to proceed with the complaint. The disciplinary committee will then make an appropriate ruling about the way forward,” the email reads in part.
Swirsky was charged following a complaint filed by Daleyot, an international diamond dealer.
He declined to comment, but confirmed that he will be appearing before the committee on Tuesday.
Saica spokesperson Willi Coates said the hearing will be held when all parties are available.
Last week the organisation summoned two VBS Mutual Bank executives to a public hearing, but was left twiddling its thumbs as neither attended. Asked why the members failed to arrive, Coates said the organisation did not want to speculate.
He said the date for Swirsky’s hearing would be determined by the availability of the other parties.
