Hlaudi ‘fit and proper’ for the job despite Thuli’s findings: SABC

The SABC is “still satisfied” with the services rendered by Hlaudi Motsoeneng despite the adverse findings made against him by the Public Protector.

This is one of the reasons the SABC believes that Western Cape High Court judge Dennis Davis had “erred” in not granting leave to appeal a ruling against the appointment of Motsoeneng as chief operations officer (COO).

The SABC believed that another court would therefore come to a different decision, said board chairperson Mbulaheni Obert Maguvhe in an affidavit lodged at the Supreme Court of Appeal late on Wednesday.

Maguvhe also said that Motsoeneng was a “fit and proper” person to be appointed and that the Public Protector had also indicated that the position had long been outstanding and ought to be filled.

He also argued that Motsoeneng had been employed at the SABC since 1995 and that “there was no evidence, statutory or otherwise, that a matric certificate was a requirement for the post”. 

Motsoeneng was appointed permanent COO two years ago despite damning findings made by the Public Protector, Thuli Madonsela, while he was acting COO. 

This decision prompted the Democratic Alliance to approach the courts for a review of the decision. The court ruled in its favour.

Last month, Judge Davis dismissed with costs the SABC’s application for leave to appeal.
