The National Council of Provinces (NCOP) has backed the decision by the Gauteng provincial government to place the city of Tshwane under administration.
The NCOP made the decision following its sitting on Thursday morning where it considered the proposed dissolution of the Tshwane Metropolitan Council.
The NCOP adopted a report by the select committee of the department of cooperative governance and traditional affair in the council to have the Tshwane metropolitan municipality dissolved.
Eight provinces voted for the adoption of the proposed dissolution while only, the Western Cape, whose administration is led by the DA, voted against the proposed move.
Tshwane has been without a mayor and municipal manager after several failed attempts by the DA to elect a new mayor.
Former mayor Stevens Mokgalapa resigned last month after only a year at the helm following a disciplinary hearing to answer to statements he made in a purported sex tape widely circulated last year.
The DA has, on numerous occasions subsequent to this, tried to elect a new mayor but the ANC and the EFF walked out and boycotted council sittings.
This led to Gauteng Premier David Makhura invoking section 139 of the Constitution two weeks ago, following the collapse of several council meetings and placing the city under administration.
The DA is challenging the decision in court.
The party has argued it is able to keep running the capital city and it would be reckless to hold by-elections while national government is trying to contain the coronavirus.
DA mayoral candidate for Tshwane Randall Williams told an NCOP hearing at the Tshwane Chambers on Tuesday that dissolving the council now would endanger the lives of the residents in the wake of the spread of coronavirus.
